Man Sues McDonald's After Allergic Reaction to Cheeseburger


A West Virginia man is suing McDonald's for $10 million after he claims he suffered an allergic reaction to a cheeseburger.

Jeromy Jackson says he clearly ordered two Quarter Pounders without cheese at a restaurant, and suffered the reaction when he bit into the burger without checking, according to the Charleston Daily Mail.

The lawsuit alleges the man "was only moments from death" by the time he reached a hospital.

"We're interested in seeing McDonald's take responsibility and change a systemic quality control problem that endangers the lives of up to 12 million Americans with allergies," said Jackson’s lawyer Timothy Houston.

The lawsuit seeks damages on two counts of negligence, one count of intentional infliction of emotional distress and one count of punitive damages.

The fast-food giant has been sued before. In 1992, a jury awarded 79-year-old Stella Liebeck of Albuquerque, N.M., nearly $3 million in damages after she suffered third-degree burns from a spilled cup of coffee.

Ha ha...this happened in West Virginia. I don't think he can win this case since he didn't check the cheeseburger himself, you never know though.

It's not the responsibility of the restaurant to know every damn persons medical history and what they are allergic to. If he had food allergies, he should have asked what was in the burger. BTW, what is it they claim he had the reaction to? The beef, cheese, or some other foreign ingredient?

Either way, it's cases like this that cause consumer cost to rise. No wonder I'm paying 6.00 for a "value" meal.

lol this sounds like a scam to me. you can clearly see the cheese on these when you order them. and every single one of these i get a little piece of the cheese gets stuck to the box thing they come in.

I think this a set up as well. From other reports I read he made it specifically clear to them at the speaker that he wanted no cheese. Then when he pulled up to the window he again said to make sure it had no cheese. Then when he pulled up to the second window he again said make sure it has no cheese. Then he said he drove to a movie theatre 40 minutes away and took the food inside to eat it and he didn't notice it had cheese on it because it was dark. He then had his mom call the McDonalds and tell them that they had put cheese on his quarter pounder when he had specifically requested them not to.

Sounds like this guy was trying to cover all his bases.

If he actually wins it will be sad...lol

LOL that definitely sounds like a setup. Why the fuck would you get fast food then drive 40 minutes to a theater to eat it? that is fucking retarded. I can see driving 10 or so to go home. Plus most theaters that I've been to don't allow you to bring in food from outside.
