aids a loaded gun?

so I'm reading in my case book for criminal law and I get a case where a guy who knows he's HIV infected (had even been warned by doctors to always practice safe sex), and he goes out raping girls.
he's tried and convicted of assualt w/ intent to murder his rape victims.
he appeals and the Maryland court of appeals lets him off the hook for the intent to murder (he still gets assault and rape so he's not entirely off the hook).
the court says he knew he was infected, but he wasn't intentionally trying to infect the girls he raped. is that right judgy boy?

they brought up other cases saying he would be guilty if he'd showed intent to infect the girls (like in one case where a guy shouted "I'll give you Aids" while attacking someone w/ a used needle).

I don't know. I guess I can see where they're coming from, but I still say if he raped the girls while KNOWING he had hiv, he should be guilty of attempted murder then. he didn't take any cautions to protect his rape victims, he knew or had reason to know that he would likely infect them.
it's at least recklessness, but that's not the same as intent.

so, is a genitalia w/ aids the same as a loaded gun?

If someone knows they have HIV/AIDS then they know there is a strong chance that he will infect the women so I think he was trying to infect them on purpose.
