People have been saying that if they're 100% sure that they should be able to recieve it. The thing is, if someone is convicted of a crime it's assumed that the judge/jury was 100% sure that they did it. That's not really the case, but it's the way it's supposed to work. People don't go to jail because the jury decided there was a 69% chance of them doing it. It's all or nothing.
